Compensation for RTA pedestrian

Mrs. Justice Cox has approved compensation for a Neasden woman who suffered brain damage following a road traffic accident in 2008.

The accident happened on January 16 on the North Circular Road when Mrs. Devbai Patel was walking home from shopping. The 60 year old who lives at Carnfield Avenue, Neasden was hit by a truck that careered onto the pavement before crashing into the wall of a vet’s surgery.

Mrs. Patel was airlifted to hospital where she had to undergo surgery after suffering multiple fractures and severe head injuries. She sustained brain damage, remained in intensive care for 2 weeks and was only discharged to her husband’s care after months of rehabilitation. Mr.Kunverji Patel now looks after his wife who needs extra care and assistance with basic living.

The accident claimed a fatality. Mr. Stephen Moore, the driver of the truck was killed in the incident which happened when another motorist crashed the rented Vauxhall he was driving into a Peugeot which in turn collided into the truck, causing Mr. Moore to lose control. The Vauxhall driver later was charged with and pleaded guilty to death by careless driving.

Approving the settlement ordered against the insurers of the Vauxhall driver, Mrs Justice Cox awarded a £750,000 lump sum and £25,000 annually, index-linked and tax free.
